Accused of Stalking In Wisconsin?

Fight Back with an Aggressive Criminal Defense

Like any criminal charge, stalking is treated very seriously under Wisconsin criminal laws, and should be handled carefully by an experienced defense lawyer.

According to the laws of Wisconsin, to be found guilty of stalking, the state must prove:

  • Defendant intentionally engaging in a course of conduct directed at another
  • The course of conduct would have caused a reasonable person to suffer emotional distress, or to fear bodily injury or death to themselves or a member of their family or household; or
  • Defendant’s acts caused another to suffer serious emotional distress or induced fear in another of bodily injury or death to themselves or a member of their family or household; or
  • Defendant knew or should have known that at least one of the acts constituting the course of conduct would cause another to suffer serious emotional distress or place the person in reasonable fear of bodily injury or death to themselves or their family or household

Wisconsin Stalking Penalties

Stalking is a misdemeanor crime under Wisconsin state law, and the maximum penalty is 3 years and 6 months prison and a $10,000 fine.

Stalking Defense Strategies

There are a number of legal strategies we can use  to beat a stalking charge. We can challenge whether the statute is applicable, and whether or not serious emotional distress was caused. If the evidence against you isn’t very strong, we will try to get the cased dismissed. And there may be other motions that can be filed depending on the facts of the case. There also may be a chance to negotiate for a lesser charge.
